I, Thomas Burgan of Baltimore County in the State of Maryland, being in perfect health of body and of sound and disposing mind and memory and understanding, considering the certainty of death and the uncertainty of the time thereof, and being desireous to settle my worldly affairs, and thereby be the better prepared to leave this world when God pleases to call me hence, do therefore make and publish this my last will and testament in manner and form following, that is to say: First and principally I commit my soul into hands of Almighty God and my body to the earth to be decently buryed at the discretion of Executors herein after named; and after my debts and funeral charges are paid, I devise and bequeath as follows. Item. I give and devise unto my son Philip Burgan that part of my plantation that he now resides on with all the improvements that he has put on the same or may hereafter put or cause to be erected with an equal number of acres of land after a division shall be made in the most convenant and ajacent manner as possible can be don, the same for him and his heirs to possess and occupy for ever Item 2nd I give and devise unto my son Thomas Burgan to that part of any plantation that he now resides on in the same manner as my son Philip is discribed. Item 3. I give and devise unto my daughter Ann Johnson and the lawful begotten heirs of her body for ever all that part of my plantation on which she now lives in the same manner as is discribed unto my son Philip. Item 4th I give and devise unto my daughter Elizabeth Franklin and the lawful begotten heirs of her body for ever all that part of my plantation on which she now resides in the same manner as is described unto my son Philip. I give and devise unto my daughter Rachel Forrester and the lawful begotten heirs of her body for ever all that part of my plantation on which she now resides in the same manner as is described unto my son Philip. Item 7th I give and devise unto Elizabeth Burgan the wife of my acknowledged son John Burgan (deceased) that part of any plantation on which John Burgan formerly resided to consist of twenty acres of land beginning at where a Gum tree formerly stood and running with the outside line of dear bit until it come with a straight line to the places of division between Thomas Burgan and the aforesaid twenty acres for her the said Elizabeth Burgan to hold and occupy the said land with the improvements thereon during her natural life and at her decease the aforesaid property shall descend unto Susan Bidision and her lawful begotten heirs for ever (the aforemention Susan Biddison is the daughter of the above mentioned John Burgan and Elizabeth Burgan) Item 8th Whereas my son Joseph Burgan hath highly offended and disobliged me by his bad conduct and hath rendered himself unworthy to be called or taken notice of as a son, I do hereby declare that his portion of my estate shall be no more than one dollar to be paid to him by my Executors herein after mentioned at any time after my decease when he may apply for the same. Item 9thI give and devise unto my sons wife (Deborah Burgan) my home place that I now occupy with the improvements thereon together with the same equal number of acres of land as the division may make in the same manner as my son Philip Burgan's is described, for her the said Deborah to hold the same so long as she may be the wife of my son Joseph and no longer, and after her death or intermarriage with any other person the aforesaid property to desend unto my four Grand-children that is to say, Philip Burgan, John Burgan, Elizabeth Burgan, and Amelia Burgan & their heirs for ever and in case that either of the aforesaid children should die before they arive at the age of maturity the surviving child or children shall enjoy the aforesaid property share and share alike and when the property shall be divided it is my wish that the above mentioned John, to have his first choice, that Philip, shall have the second choice, Elizabeth shall have the third choice and Amelia the last, I also devise that my personal property be sold at public auction and my debts and funeral expenses be first paid out of the proceeds and the balance if any to be equally divided between my sons Philip & Thomas and my daughters Ann Elizabeth, Rachel & Mary, and Lastly I do hereby constitute and appoint my two sons Philip and Thomas to be sole Executors of this my last will and and testament revoking and annulling all former witts made, ratifying and confirming this and none other to be my last will & testament. In Testimony whereof I have here unto set my hand and affixed my seal this twenty fourth day of September in the year of our Lord one thousand eight hundred and twenty three.''
